By accessing or using this website, you agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must not use this website.


2. Services and Content

2.1 Content Availability

Cheercast provides users with access to various content, including but not limited to:

  • Routine videos (streaming and downloads)
  • Routine photos
  • Event schedules and competition results (where provided by the Event Provider)
  • News articles and editorial content (provided by Cheercast)
  • Partner promotions, discount offers, and coupons from time to time

The availability of specific content may vary depending on the services Cheercast is engaged to provide by the relevant Event Provider (“EP”).

2.2 Content Ownership

All videos, photos, and other event-related materials made available on Cheercast are owned by the respective Event Providers. Cheercast acts as an authorised distributor of this content on behalf of the Event Providers.

Event Providers grant end-users a limited, non-exclusive, non-transferable licence to view content on the Cheercast website and download content to their personal device, strictly for permitted personal use.

2.3 Access Period

Users are granted access to each event’s content for a minimum of 12 months following the event date. After this period, content may be removed from the Cheercast platform at our sole discretion, without notice.

2.4 Permitted Use of Content

Unless otherwise specified:

  • Content provided through Cheercast on behalf of Event Providers is for personal use only.
  • Users are permitted to share routine videos and photos on social media or other online services for personal, non-commercial purposes. No attribution is required for such personal sharing.
  • Content created directly by Cheercast — including but not limited to original videos, news articles, editorial content, and promotional materials — is the exclusive property of Cheercast and is protected by copyright. Such content may not be copied, reproduced, shared, or distributed without prior written consent.
  • Any commercial use, resale, republication, or redistribution of content is strictly prohibited without prior written consent from both the Event Provider and Cheercast. Where such permission is granted, appropriate attribution will be required.
2.5 Removal or Modification of Content

Cheercast reserves the right to remove or modify content at any time, including at the request of Event Providers, due to licensing changes, or for platform updates.


3. User Accounts

3.1 Account Registration and Eligibility
  • To access certain content and services on Cheercast, users are required to create an account.
    • Users must be at least 13 years of age to register an account.
    • Users aged between 13 and 17 years old may only register with the consent of a parent or legal guardian.
    • Children under the age of 13 are not permitted to create an account. However, a parent or legal guardian may create and manage an account on behalf of a child under the age of 13.
3.2 Account Security and User Responsibility

You are responsible for maintaining the confidentiality of your login details and all activities under your account. You agree to:

  • Keep login credentials secure
  • Notify Cheercast immediately of any unauthorized use
  • Accept responsibility for activity under your account until such notice is given
3.3 Program Linking and Content Access
  • Users may only link their account to one Program at a time.
  • Linking changes are limited to three times per calendar year and no more than once per month.
  • Creating multiple accounts to bypass linking restrictions is strictly prohibited, except in cases where:
    • The user participates in multiple Programs (e.g., cheer and dance),
    • Has explicit permission from both Programs (via a linking password), and
    • The Programs are not already listed as affiliated Programs within the Cheercast platform.
  • Where a Program has an affiliated Program, users may link accounts to both. Otherwise, multi-Program linking is not permitted.
3.4 Account Suspension and Termination

Cheercast may suspend or terminate accounts, with or without notice, for:

  • Breach of these Terms and Conditions
  • Abuse, harassment, or fraud
  • Attempts to circumvent Program linking restrictions
  • Inappropriate conduct
  • Any activity compromising platform integrity or security, at Cheercast’s sole discretion
3.5 Program Administrator Access & User Removal

Program Administrators who manage their Program’s presence on the Cheercast platform have access to a list of users currently linked to their Program. This list includes each linked user’s first name, last name, and email address.

Program Administrators may submit requests to remove linked users from their Program.

  • All removal requests are reviewed and approved by Cheercast before being actioned.
  • Program Administrators must provide a clear reason for the removal request.
  • Affected users will be notified and have the right to dispute the removal. During the dispute process, the user’s access to that Program’s content will be temporarily disabled.
  • If the removal request is approved by Cheercast, the user will be permanently prevented from re-linking to that Program.
  • User accounts will not be terminated as a result of a Program-level removal unless the user is also found to have violated Cheercast’s platform-wide Terms and Conditions.

4. Paid and Free Content

4.1 Free Content

All routine content made available on Cheercast — including videos and photos from competitions — is provided free of charge and will remain free for users who have an active account and are properly linked with the relevant Program.

4.2 Paid Live Streams

From time to time, Cheercast may facilitate the delivery of live streams of Cheer and Dance competitions on behalf of an Event Provider (“EP”).

  • Any fees associated with live streams are set by the Event Provider, not by Cheercast.
  • All payments for live streams are made directly to the Event Provider. Cheercast simply facilitates the payment process as an agent of the Event Provider and is not the seller of these services.
  • Payments are processed securely via Stripe.

4.3 Refunds for Paid Live Streams

Refunds for live stream purchases are available only in the event that the competition or event is cancelled or does not go ahead. All other refund requests will be declined.

4.4 Changes to Pricing and Payment Terms

Cheercast does not set pricing for paid live streams. Event Providers reserve the right to change pricing and payment terms at their discretion. Users are encouraged to review the pricing and terms provided by the Event Provider prior to purchase.


5. Privacy and Data

5.1 Privacy Policy

Your privacy is important to us. Please refer to our Privacy Policy, which forms part of these Terms and Conditions. The Privacy Policy explains how we collect, use, store, and protect your personal information.

5.2 Information We Collect

Cheercast may collect the following personal information from users:

  • First name and last name
  • Email address
  • Postcode, state, and country of residence
  • Age bracket (for verification and compliance purposes)
  • User type (e.g., athlete, supporter, program owner, coach)
  • Location data and device information (when submitting forms via our support system)

5.3 Use of Cookies

Cheercast uses cookies and similar technologies to:

  • Facilitate login and secure session management
  • Prevent multiple or unauthorized simultaneous logins
  • Track engagement with emails and platform notifications
  • Store and respect user preferences

5.4 Third-Party Services

Cheercast integrates with several third-party services to deliver our platform, including:

  • Stripe (for secure payment processing)

By using the Cheercast platform, you acknowledge and accept that there are inherent security risks in providing and transmitting personal data online, and Cheercast is not liable for any unauthorized access, hacking, data loss, or breaches beyond our reasonable control.


6. Liability and Disclaimers

6.1 Platform Availability and Technical Issues

Cheercast provides this platform on an “as is” and “as available” basis. While we strive to ensure consistent access and functionality, we make no guarantees regarding uninterrupted service, error-free operation, or availability of content. Cheercast disclaims any liability for outages, technical disruptions, or loss of data.

6.2 Accuracy of Content

Information such as event schedules, results, or other content provided by Event Providers is published in good faith. Cheercast is not responsible for errors or inaccuracies in such content and disclaims liability for any reliance placed on it. Users are encouraged to confirm event details with the relevant Event Provider directly.

6.3 Content Availability

Cheercast reserves the right to modify or remove content at any time, including content older than 12 months, without notice. Cheercast is not liable for any loss arising from changes in content availability.

6.4 Third-Party Services and Links

This platform may include links to, or integrations with, third-party services including but not limited to Stripe, Vimeo, Dropbox, Google Analytics, Better Stack, and Help Scout. Cheercast does not control and is not responsible for the content, policies, or security practices of these third-party services. Your use of such services is at your own risk and subject to their respective terms and conditions.

6.5 Use at Your Own Risk

By using Cheercast, you acknowledge that streaming quality, availability, content accuracy, and performance may vary depending on a range of factors outside Cheercast’s control. You use the platform and its content at your own risk.

6.6 Limitation of Liability

To the maximum extent permitted by law, Cheercast, its directors, employees, agents, and contractors will not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the platform.


7. Dispute Resolution and Jurisdiction

7.1 Dispute Resolution

In the event of any dispute arising from your use of the Cheercast platform, we encourage you to contact us first at support@cheercast.com.au to seek a prompt and amicable resolution.

7.2 Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia.

7.3 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia, in relation to any dispute arising under or in connection with these Terms and Conditions or your use of the Cheercast platform.

7.4 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed to the minimum extent necessary, and the remainder of these Terms will remain in full force and effect.


8. Changes to Terms

8.1 Updates to Terms and Conditions

Cheercast reserves the right to update or modify these Terms and Conditions at any time, at its sole discretion. Any changes will be effective upon posting on the Cheercast website.

8.2 Notice of Changes

Where changes are material, we will make reasonable efforts to notify users via email or through prominent notices on the platform.

8.3 Acceptance of Changes

By continuing to use the Cheercast platform after changes to these Terms and Conditions are posted, you agree to be bound by the updated terms. If you do not agree to the updated Terms, you must stop using the platform and may request the closure of your account.


9. General Provisions

9.1 Entire Agreement

These Terms and the Privacy Policy constitute the full agreement.

9.2 Waiver

Failure to enforce any provision is not a waiver.

9.3 Assignment

Cheercast may assign rights; users may not without consent.

9.4 Force Majeure

Cheercast is not liable for delays or failures due to causes beyond our control.
